I. General Terms and Conditions
§ 1 Basic Provisions
(1) The following terms and conditions apply to all contracts that you conclude with us as the provider RMT Vintage Portfolio Watch Management GmbH via the website www.vp-treasuryClose .com. “Vintage Portfolio Treasury” is a trademark RMT Vintage Portfolio Watch Management GmbH. Unless otherwise agreed, the inclusion of your own terms and conditions is completely rejected. If these "own terms and conditions" cannot be rejected, no purchase contract would be concluded.
(2) A consumer within the meaning of the following provisions is any natural person who concludes a legal transaction for purposes that can predominantly be attributed neither to their commercial nor to their independent professional activity. An entrepreneur is any natural or legal person, or a partnership with legal capacity, who, when concluding a legal transaction, acts in the exercise of their independent professional or commercial activity.
§ 2 Conclusion of the contract
(1) The subject of the contract is the sale of goods. The goods offered by us (both on this website and through advertisements on other websites) are non-binding invitations to submit an offer on your part, but in no way constitute binding offers on our part. (This prevents Goods unintentional sold twice)
(2) We invite you, to submit a binding purchase offer (order) by contacting us (by telephone or email).
(3) We will accept your purchase offer (and thus conclude the contract) by sending you a written confirmation (e.g., email). If you do not receive a corresponding notification within three days, you are no longer bound to your order. In this case, any payments already made will be refunded immediately.
(4) Quotations for the purpose of submitting an offer and any offers are non-binding until they are expressly accepted. This means that until the purchase contract is concluded (through the submission and acceptance of the offer), the product can be sold to another interested party.
§ 3 Retention of title
(1) The goods remain our property until the purchase price has been paid in full.
§ 4 Warranty, Guarantee and exchange rights
(1) The statutory liability for defects (warranty) applies of one year on used goods, with the burden of proof shifting after six months. Regardless, we guarantee the authenticity of the goods we sell. (It is important to note that if Goods is clearly described and sold as "defective," the guarantee (and warranty) only applies to this defective condition. This means that in this case the responsibility and risk lies with the buyer. Goods to have it repaired because it was sold as defective. If the Goods but is sold as “working” and within the warranty period gedeckt, it is a classic warranty case and the customer is entitled to free repair through us.
(2) The warranty applies if the watch delivered does not correspond to the condition contractually agreed at the time of conclusion of the contract, i.e. “is completely different from what was actually discussed or advertised and sold”.

(5) All of our watches (unless otherwise stated in the listing description) are NOT waterproof. They are also NOT waterproof even if the case says "Waterproof." The water resistance standard in the 1950s and 1960s was different than it is today, and only diving watches were truly waterproof back then. Furthermore, water resistance is essentially only a temporary condition that must be checked regularly. Therefore, we do not offer a guarantee or warranty for water resistance. Even if a water resistance test certificate is included with the watch, it can only prove the water resistance at the time of testing.
(5) For watches: For movements described as "accurate," a deviation of +1 // -1 minutes per day (24 hours) is considered to be agreed upon as accurate. Most watches sold exhibit significantly better accuracy (usually +-15 seconds per 24 hours), but this cannot be guaranteed or warranted under any circumstances – even if stated as the current condition in the advertisement description. These accuracy values depend heavily on the buyer's positioning and wearing behavior, as well as the magnetism of the environment, and can therefore vary. Upon request, the current accuracy of the watch can be determined more precisely by a timegrapher measurement. For rate deviations greater than +1 // -1 minutes per day (24 hours), the watch is considered defective, and agreed guarantees and warranty rights generally apply unless they meet the exceptions set out in Section 3(4) of this text.
(6) You are obligated to inspect the goods immediately upon receipt and with due care for any deviations in quality or quantity, and to notify us of any obvious defects in writing within 14 days of receipt of the goods, preferably by phone or email. This also applies to defects discovered later upon discovery.
6) In the case of defects, we provide a warranty by means of repair. This repair may only be carried out by our partner No compensation can be provided for repairs carried out independently or by third parties and all guarantee and warranty claims will be void., unless otherwise agreed between usIf the remedy of the defect fails, you can request a price reduction, an exchange, or a return of the goods. The remedy of the defect is valid no later than six months as failed if the Goods turns out to be irreparable.
7) Exchanges or any rights to exchange are excluded unless, in exceptional cases, expressly agreed or discussed in advance.
§ 5 Liability
(1) If material contractual obligations are affected, our liability for slight negligence is limited to the typical, foreseeable damage. Material contractual obligations are (a) obligations arising from the nature of the contract, the breach of which jeopardizes the achievement of the contractual purpose, and (b) obligations imposed on us by the contract to achieve the contractual purpose, (c) the fulfillment of which makes the proper execution of the contract possible in the first place and on whose compliance you can regularly rely.
(2) In the event of a breach of minor contractual obligations, liability is excluded even in the case of only slightly negligent breaches of duty.
(3) Given the current state of technology, data communication via the internet cannot be guaranteed to be error-free and/or available at all times. We therefore assume no liability for the constant or uninterrupted availability of the website and the services and products offered there.
§ 6 Choice of Law, Place of Performance, Place of Jurisdiction
(1) Austrian law applies.
(2) The place of jurisdiction is Vienna.
§ 7 Severability Clause
(1) Should individual provisions of this contract be invalid or unenforceable, or become invalid or unenforceable after conclusion of the contract, the validity of the remaining provisions shall remain unaffected. The invalid or unenforceable provision shall be replaced by a valid and enforceable provision whose effects most closely approximate the economic objective pursued by the contracting parties with the invalid or unenforceable provision. The above provisions shall apply accordingly in the event that the contract proves to be incomplete.

2. Information on the conclusion of the contract
2.1. The technical steps for concluding the contract, the conclusion of the contract itself and the correction options are carried out in accordance with Section 2 of our General Terms and Conditions (Part I).
3. Contract language, contract text storage
3.1 The contract language is German or English.
3.2. You will receive all contract details as part of an invoice by email, which you can print out or save electronically.
4. Essential characteristics of the goods or service
The essential characteristics of the goods and/or services can be found in the item description and the additional information on our website.
5. Prices and terms of payment
5.1. The prices and shipping costs stated in the respective offers represent total prices. They include all price components, including all applicable taxes. This excludes deliveries outside the EU (i.e., the USA, Asia, etc.). Exports to these areas will incur additional customs fees and import duties. These are the responsibility of the buyer.
5.2. We reserve the right to make changes of any kind prior to the conclusion of the contract, particularly to product prices. These changes may be caused by errors or changes in the market situation.
5.3. The shipping costs incurred (unless otherwise stated) are not included in the purchase price but are shown in the course of the offer and are to be borne by you additionally, unless free shipping has been promised.
5.4 Payment is by bank transfer, credit card or PPayPal is possible. Please let us know which payment method you prefer when submitting your offer. Otherwise, we will assume a bank transfer, and you would have to pay the PayPal fees. Cash payments or cash on delivery are possible by arrangement.
5.5 Unless otherwise stated on the invoice for the individual payment methods, the payment claims arising from the concluded contract are due for payment immediately.
6. Terms of Delivery
6.1. The goods will be dispatched as soon as possible after receipt of payment, normally within 48 hours, but no later than 5 working days after receipt of payment. If dispatch does not occur within this period, the buyer has the right to withdraw from the contract and reclaim the amount paid. himself within Austria usually takes 1-2 Working days and within Europe usually 2-3 Working days. Outside the EU, shipping usually takes 7-10 days.
6.2. As a business, we bear the shipping risk, unless you have independently commissioned a transport company not selected by us or another person designated to carry out the shipment. In this case, you would bear the risk of loss of the item being transported.
